Major Development in GLP-1 RA’s Personal Injury Litigation
There was a significant advancement in the litigation surrounding GLP-1 RA’s personal injury cases last week.
All federal lawsuits against manufacturers of GLP-1 RA’s, including Ozempic, Wegovy, Rybelsus, Trulicity, and Mounjaro, were consolidated for pre-trial purposes into a multidistrict litigation (MDL 3094).
This consolidation was ordered by the Judicial Panel on Multidistrict Litigation (JPML) and took place in the Eastern District of Pennsylvania under the supervision of the Honorable Gene E. K. Pratter. The JPML recognized Judge Pratter as an experienced MDL jurist, expressing confidence in his ability to guide the litigation towards a careful and timely resolution.
This MDL encompasses all medications containing semaglutide as the active molecule.
Implications of the Consolidation for Federal Cases against GLP-1 Manufacturers
The consolidation implies that every federal case involving any of these products related to injuries will now be unified for pre-trial processes in the multidistrict litigation pending before Judge Pratter in the Eastern District of Pennsylvania.
Judge Pratter is tasked with overseeing all aspects of case management, including consolidated discovery, expert testimony, bellwether trials, briefing, and potential remand for trial. As the number of cases grows, the court will designate special masters to assist with various aspects, notably supervising the parties’ discovery processes and expert evaluations, as well as examining settlement options.
